Prohibited Uses

You will not assign, sublicense, transfer, pledge, sell, lease, rent, lend, or otherwise copy the content, or any part of it, or share your rights under this Agreement, to others.

Consent to Use Information

When you communicate with us, send us information, or provide content to us or out website, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise all copyright and publicity rights you have in the content, in any manner whatsoever, in any media now known or which may be created in the future, including in other works and forms not associated with this website.

No Waiver of Rights

Our failure to enforce any rights granted in this Agreement or to take action against any other party in the event of any breach shall not be deemed a waiver by us as to subsequent enforcement of rights or subsequent actions in the event of future breaches.

Payment

Commissions will be paid once a month between the 10th day and the 20th day of each month. There is no need to request payment. Payments will be sent automatically after you have reached the mimimum payout amount. The Minimum Payout amount is $10. Any ammount including or exceeding $10 will be paid in full. All monetary figures are in USD. Payments will only be sent by PayPal. If you have not entered a PayPal address before commissions are paid, all of your earnings will be lost. Again, you must enter a PayPal address to receive commissions.

Members are responsible for any and all aspects of reporting their own affiliate income (for tax purposes, etc.) Until the individual or business reaches an amount of $600 or more within a year. At that time we will require a W-9 Form before paying out any more commissions to the individual or business.

Email Deliverability

You agree to maintain a valid email address and your account is only activated once you have verified your email address by clicking a link in an email sent to you. By doing so you are bound to accept email from Networking-The-Evolution.com which will include system messages and marketing information. This is an opt-in service and you can choose to receive emails or not by editing your profile. Failure to maintain a valid email address may result in account termination. Any user threatening or reporting Networking-The-Evolution.com for sending 'spam' or Unsolicited Commercial Email will their account deleted immediately. Further more all legal costs and compensation will be sought through the courts for any loss of time or reputation.

Termination of Service

You agree that Networking-The-Evolution.com, in its sole discretion, may terminate your password, account (or any part thereof) or use of the service, and remove and discard any content within the service, for any reason, including, without limitation, for lack of use or if Networking-The-Evolution.com believes that you have violated or acted inconsistently with the letter or spirit of this Agreement. Networking-The-Evolution.com may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice.

You agree that any termination of your access to the service under any provision of this agreement may be effected without prior notice, and acknowledge and agree that Networking-The-Evolution.com may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the service.

Further, you agree that Networking-The-Evolution.com shall not be liable to you or any third-party for any termination of your access to the Service.

Miscellaneous

This Agreement in all respects shall be governed by and construed according to the laws of the State of Pennsylvania, USA, to the exclusion of any other applicable body of governing law, without regard to conflicts of laws principles.

This Agreement is entered into in Pennsylvania, USA. You consent to the exclusive jurisdiction of Pennsylvania for any dispute arising from or related to this Agreement.

You agree that the exclusive venue for any dispute arising from or related to this Agreement will be a court located in Pennsylvania, USA.

Should any term of this Agreement be declared void or unenforceable, that term shall be severed from the Agreement such declaration shall have no effect on the enforceability of the remaining terms.

This Agreement contains the complete and entire understanding and agreement between you and us and supersedes any previous communications, representations, or agreements, verbal or written, related to the subject matter of this Agreement.

This Agreement may not be modified or amended orally, impliedly, or in any manner not set forth in writing or permitted by this Agreement.

This Agreement may be amended by us at any time and without notice, but only by amending this Agreement as posted on this website, unless otherwise agreed to in a writing signed by both of us.

Any amendments will become effective 30 days after being posted on the website, unless circumstances require that a change be immediately implemented. As a condition for this Agreement you agree to periodically check this Agreement posted at this page.

You agree that your continued use of our product or service after that date will constitute your consent and acceptance of the amendment
